A Few of Our Services
A basic estate plans consists of a Last Will and Testament, General Financial Power of Attorney, Health Care Power of Attorney, HIPAA election, and Declaration of Living Will.
Last Will & Testament
This dictates who will receive your assets upon death. It may include a trust (called a testamentary trust that goes into effect upon death) to appoint a trustee to manage assets for the beneficiary(ies) if, for some reason, you prefer the inheritance is not distributed in a lump sum. An Executor is appointed who will ensure the terms of the Will are carried out after death, and work with an attorney through the succession process. A Last Will and Testament must be drafted and executed in a very particular manner in order to be valid.
Revocable Living Trust
This is another tool many clients prefer, in place of a Last Will and Testament, which has an added bonus of avoiding a public succession or probate, as long as the trust is properly funded. An inter vivos trust (created during life) dictates how the trust assets are managed during life and by whom, and specifies the terms of distribution and management of the assets after death of the trust creators (called Settlors or Trustors).
General Financial Power of Attorney (or Louisiana Mandate)
This is a legal document, properly drafted and executed by the Principal (person giving the power) to give authority to an Agent (person acting on behalf of Principal), over the Principal’s finances. This document is typically very comprehensive to be sure it allows the Agent to stand in the shoes of the Principal, in the event of Principal’s incapacity, although a Power of Attorney is often drafted to be effective upon execution, rather than upon incapacity. A Power of Attorney is only valid during life and dies with the Principal.
Health Care Power of Attorney
It’s similar to the General Power of Attorney mentioned above, except the Principal is giving an Agent authority to make medical decisions with regard to authorizing or refusing medical procedures, communicating with doctors and medical facilities, and acting as the Principal’s HIPAA representative.
HIPPA
HIPAA stands for Health Insurance Portability and Accountability Act of 1996, which prevents medical professionals from sharing private medical information with anyone other than the patient. A HIPAA Release gives your agent access to your medical information so that your Health Care Agent can make competent and informed decisions on your behalf.
Declaration of Living Will
This allows you to make important end-of-life decisions regarding whether you wish to continue medical treatment once two doctors certify, in writing, that there is nothing further that can be done medically to heal your condition. Executing a Living Will while you are competent and able to make decisions means your wishes are known and can be followed.
